Nestlé withdrew it after the FDA refused to retreat from its position that a 1938 federal law banning nonnutritive objects inside confections made the toy-filled ball illegal.

Nestlé Magic was a hollow milk chocolate ball with a Disney figurine sealed inside, which had been illegal in the United States since 1938 under a law barring nonnutritive objects in confections. Nestlé sold it anyway in 1997, then reported a dozen incidents of children gagging on Hercules and Simba to federal regulators. With fourteen state attorneys general circling and the FDA refusing to back down, Nestlé pulled it that October.
